General litigation

We bring the necessary proceedings before the Social Division of the Judicial Court to challenge decisions recognising occupational accidents or diseases. These challenges are based on the identification of procedural irregularities and/or strong substantive arguments. At the same time, we act to contest the duration of work stoppages of occupational origin, working with court-appointed medical experts, including experts accredited by the Douai Court of Appeal.

Liability litigation: defence against gross negligence claims

W-LEGAL defends employers whose liability is challenged on the basis of gross negligence (faute inexcusable), working closely with insurance companies. Our approach is deliberately multidisciplinary because of the cross-cutting scope of the employer’s health and safety obligation:
Employment Tribunal: employer health and safety obligations,
Criminal Court: criminal implications where an offence has been committed.
This comprehensive approach, drawing on the different specialists within our firm, is essential to providing our clients with the strongest possible defence.

Technical disputes

Disability rates and annuities:
We challenge disability rates before the Medical Amicable Appeals Commission and, where necessary, before the Social Division of the Judicial Court. As these rates directly affect employers’ accounts and workplace-accident/occupational-disease contributions, they require rigorous analysis and the involvement of medical experts.
Contribution-rate disputes:
Our firm acts before the contribution-rate division of the Amiens Court of Appeal to challenge contribution rates, occupational-risk classifications and the consequences of corporate succession or the creation of new establishments.
